The Kerala Congress shared a derogatory post about the Chief Justice of India. The Supreme Court has taken a strong view of this post and issued notices to all its officials.
Supreme Court strict on objectionable post of Congress
The Supreme Court has taken a strong stance on the Kerala Congress's derogatory post against Chief Justice of India Surya Kant. A bench headed by Justice Arvind Kumar issued notices to all Kerala Congress officials, asking why criminal contempt proceedings should not be initiated against them.
'Will be dealt with strictly'
During the hearing, Justice Arvind Kumar said, "We exercise self-control, but this should not be mistaken for weakness. Freedom of expression cannot be used to justify saying anything." Describing the need for strictness in the matter, he added, "The Constitution is supreme, and we perform our duties within its ambit. We do not need the consent of any political party or organization for this. Those who attack the dignity of the court will be dealt with firmly."
What is the matter?
In fact, a controversial post was made from the official X handle of the Kerala Congress. It referred to CJI Surya Kant in a derogatory manner and demanded his resignation. The post also stated that a replacement would be found. However, after the controversy escalated, the Congress deleted the post and publicly apologized.
Cognizance taken on lawyer's complaint
In this case, lawyer Vineet Jindal wrote a letter to the Supreme Court informing it of the post and demanding criminal contempt proceedings against the Kerala Congress. Based on this letter, the Supreme Court took cognizance of the matter and filed a case.
The apology will be reviewed.
During the hearing, the lawyer representing the Kerala Congress stated that the party was prepared to apologize unconditionally and would file an affidavit to this effect. The court then said it would examine whether the apology was sincere or merely a formality on paper.
Appointed amicus curiae
The Supreme Court has appointed senior lawyer Arvind Datar and lawyer Gaurav Agarwal as amicus curiae in the case. The Attorney General has also been asked to assist the court. The court has exempted party officials from personal appearance at the next hearing. The next hearing of the case will be in December.
