Raipur. छत्तीसगढ़ हाईकोर्ट ने पत्नी के साथ सेक्सुअल रिलेशन के एक मामले में अहम टिप्पणी की. कोर्ट ने कहा कि किसी बालिग पत्नी के साथ सहमति के साथ या फिर उसके बिना यौन संबंध बनाने के लिए पति पर रेप या अप्राकृतिक संबंध का आरोप नहीं लगाया जा सकता है. सेक्सुअल रिलेशन बनाना या अप्राकृतिक संबंध में पत्नी की सहमति जरूरी नहीं है. The Chhattisgarh High Court made an important comment in a case of sexual relations with the wife. The court said that a husband cannot be accused of rape or unnatural sex for having sexual relations with an adult wife with or without her consent. Wife's consent is not necessary for having sexual relations or unnatural relations.

According to a report in the Times of India, in its verdict delivered on Monday, the court dismissed the charges against a man. Along with this, the accused was acquitted under sections 376, 377 and 304 of the IPC and ordered his immediate release from jail.

What did the court say?

अदालत ने कहा कि अगर पत्नी की उम्र 15 साल से कम नहीं है, तो पति का अपनी पत्नी के साथ किए गए किसी भी सेक्सुअल एक्ट को ऐसी परिस्थितियों में रेप नहीं कहा जा सकता है. ऐसे में अप्राकृतिक यौन संबंध के लिए पत्नी की सहमति होने की जरूरी नहीं है. इसलिए अपीलकर्ता के खिलाफ आईपीसी की धारा 376 और 377 के तहत केस नहीं बनता है. The court said that if the wife is not less than 15 years of age, then any sexual act done by the husband with his wife cannot be called rape under such circumstances. In such a situation, the consent of the wife is not necessary for unnatural sexual intercourse. Therefore, a case under Section 376 and 377 of the IPC does not stand against the appellant.
