The way the Trump government dropped the Indians in Amritsar in a military plane has led to outrage across the country, especially in the opposition. The US government is calling illegal immigrants 'aliens'. Its clear message is that such people will be identified and deported out of the country. Meanwhile, India's Foreign Minister S. Jaishankar has told the Parliament that the Indian government is in active contact with the Donald Trump administration and it is being ensured that the deported Indian immigrants are not mistreated.
What now faces the deported Indians?
According to a report in India Today, senior advocate and Delhi Bar Council chairman K K Manan said that as long as the deported people did not travel with fake documents, they will not face any legal action in India. Meaning, as long as they have a valid Indian passport and have used their valid documents, they need not worry.
He said if anyone has used a fake passport or added their photograph in someone else's passport or changed their name/date of birth or other information on the passport for the 'donkey' route, they may face action under the Passport Act. If not, they are back in their country and can go home.
Senior advocate Atul Nanda, who was the former advocate general of Punjab during the Captain Amarinder Singh government, said that there is very little possibility that these people would be involved in making fake documents because most of such people are not well educated and come from poor families.
Advocate Kamlesh Mishra, who works on such cases, told India Today that deported migrants cannot be prosecuted unless they have been convicted of any crime in the country or are involved in any passport fraud in India. Mishra said that they have been sent back to their home country. At the most, they can be questioned to see if their documents to leave the country were correct?
Can they go back?
Senior lawyers clearly say that those who have been deported as illegal immigrants cannot go back.
Advocate Nanda said that whenever you fill the visa form, there is a column asking whether you have been deported? Once they have the stigma of being deported, most countries will not give them visa.
He further said, 'Particularly countries like America, Canada, Australia, Britain will not give visa to any person who has been deported as an illegal immigrant.'
According to the US Embassy website, 'A person who has been deported may be barred from reapplying for a visa for up to 10 years, depending on the circumstances. Exemptions may be available in certain cases.' According to the US State Department, illegal 'aliens' who have been deported cannot apply for a visa for at least 5 years.
Who will be taken action against in India?
Lawyers say that after this action of the US government, India may witness a rapid action against those travel agents who send such people abroad illegally. In return, they extract money. KK Manan finally says that it is the right of every country to send illegal immigrants back to their country.
