The Supreme Court has agreed to hear the petition of judicial officers of Gujarat, whose promotion was stayed by it. The Supreme Court has listed the petition for hearing on Tuesday in July. Let us tell you that on May 12, the Supreme Court in one of its decisions had stayed the promotion of 68 judicial officers of Gujarat. Now the Supreme Court has permitted to reconsider its decision.

Chief Judicial Magistrate Hasmukhbhai Verma was among the 68 judicial officers whose promotions were stayed by a bench headed by Justice MR Shah (retd) in its May 12 judgment. It was Hasmukhbhai Verma who convicted Rahul Gandhi in the defamation case and sentenced him to two years. Now, on behalf of these 68 judicial officers, advocate Meenakshi Arora has filed a petition in the Supreme Court demanding reconsideration of its decision.

On which a bench of Chief Justice DY Chandrachud, Justice PS Narasimha, and Justice JB Pardiwala has listed the petition for hearing in July. It has been said in the petition that due to the decision of the Supreme Court, the Gujarat High Court has sent these judicial officers to their original lower cadre. It has been said in the petition that the judicial officers are feeling humiliated by this.

The Chief Justice said, "We list it for July after the summer vacation." The apex court said that the promotion of judicial officers violates the Gujarat State Judicial Service Rules, 2005. It was amended in the year 2011. Under this, promotion can be done only after passing merit cum seniority and a suitability test. This is the reason why the Supreme Court banned the promotion of judicial officers.


The petition related to the prisoners lodged in the jails of Jammu and Kashmir was transferred to the High Court.
The Supreme Court on Tuesday transferred a petition to the Jammu and Kashmir High Court. The petition alleged that more than 20 people arrested under the Public Safety Act have been transferred from jails in Union Territories to jails in different states like Uttar Pradesh and Haryana. On this, a bench of Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala transferred the petition to the Jammu and Kashmir High Court. The court said that petitions challenging the amendments made in 2018 in the Jammu and Kashmir Public Safety Act of 1978 have been filed before the High Court, so it would be appropriate to consider this petition there as well. Solicitor General Tushar Mehta, appearing in the court for the Union Territory, submitted that the facility is being provided to relatives to meet prisoners lodged in jails of other states and this is an acceptable practice.


Hearing on a petition related to the appointment of DERC chairman adjourned till 19th
The Supreme Court on Tuesday adjourned till May 19 the hearing of the Delhi government's plea alleging inaction by Lieutenant Governor VK Saxena in the appointment of the chairman of the Delhi Electricity Regulatory Commission (DERC). A bench of Chief Justice DY Chandrachud, Justice PS Narasimha, and Justice JB Pardiwala adjourned the matter after senior advocate Mukul Rohatgi, appearing for the Lieutenant Governor, sought time to file a reply.


The Tamil Nadu government responded to the Supreme Court on 'The Kerala Story'
The Tamil Nadu government told the Supreme Court that no order has been issued by it to impose any undeclared or token ban on the film 'The Kerala Story'. The government said despite the state providing necessary security to theaters and multiplexes, their owners decided to stop screening the film from May 7 due to a lack of encouraging response from the general public. The film was released in 19 multiplexes across Tamil Nadu on May 5 amid objections and protests, the state government said in response to a petition filed by the makers of the film alleging a de facto ban in the state.


Bombay High Court requested to hear Nawab Malik's bail plea
The Supreme Court on Tuesday listed the petition of jailed former Maharashtra minister and NCP leader Nawab Malik for hearing in the second week of July. The petition has been filed against the Bombay High Court order deferring the hearing on his bail plea in a money laundering case registered by the Enforcement Directorate. A bench of Justice Sanjiv Khanna and Justice MM Sundaresh requested the High Court to hear his bail application. Malik had approached the top court after the Bombay High Court's May 2 order struck down the non-availability of the Additional Solicitor General (ASG) representing the ED. In the order, his bail plea was adjourned till June 6.
