The court gave custody of the child to the mother and said that the father and his family can meet the child under supervision for the first three months. After that, the child can stay with the father from morning to evening on the first Sunday of every month.

 

 

The Supreme Court also cancelled the High Court's order to give alimony of Rs 1.5 lakh per month to the woman.

 

The Supreme Court on Tuesday (July 22, 2025) directed a woman officer of the Indian Police Service (IPS) to apologize to her husband and father-in-law, against whom she has filed a case, and they are in jail. The court has also strictly instructed the IPS wife that she will not use her position and power against her husband. The court has directed to publish the apology in reputed English and Hindi daily newspapers.

According to a PTI report, the IPS officer was living separately from her husband since 2018. Using its extraordinary powers, the court allowed the estranged husband and wife to end their marriage and also quashed several civil and criminal cases filed against each other. The Supreme Court also quashed the High Court's decision, which directed the husband to pay alimony of Rs 1.5 lakh to the woman every month.

 

 

A bench of Chief Justice Bhushan Ramakrishna Gavai and Justice Augustine George Masih directed the woman IPS officer and her parents to tender an unconditional apology to the family of her estranged husband. The bench, exercising powers conferred under Article 142 of the Constitution, ordered an end to the long legal battle between them after their marriage which took place in 2015 broke down in 2018.

Article 142 empowers the Supreme Court to issue any order necessary for the purpose of complete justice in any case pending before it. The bench noted the submissions of both the parties that they wish to resolve all disputes amicably, including the matter of custody of the daughter, and to dispose of all pending cases to avoid any litigation in future and maintain peace.

 

On the issue of custody of the daughter, the bench said, "The custody of the child will be with the mother. The father... and his family will have the right to meet the child under supervision for the first three months and thereafter based on the convenience and well-being of the child... on the first Sunday of every month from 9 am to 5 pm at the place of education of the child, or as permitted under the rules and regulations of the school."

 

The bench also considered the fact that the woman has voluntarily agreed to give up her claim for any kind of alimony from the husband. As a result, the Supreme Court set aside the High Court order awarding maintenance of Rs 1.5 lakh per month to the wife.

 

In its order, the bench said, 'In order to put an end to the protracted legal battle between the two parties and to ensure complete justice, all pending criminal and civil cases filed by both the parties against each other, including but not limited to the cases filed against the wife, the husband and his family members in any court or forum in India, are hereby quashed and/or withdrawn.

 

The bench also quashed the cases filed against them by third parties, which both the parties were not aware of. The court considered the fact that the husband and his father are in jail due to the cases filed by the IPS wife. The bench asked the woman officer and her parents to apologize to them unconditionally.

 

The apology was directed to be published in the national edition of a reputed English and Hindi daily. The bench directed the woman officer to never use her position and power as an IPS officer against her ex-husband.
