The court said during the hearing that it has been emphasized that making Aadhaar submission mandatory would violate the fundamental rights protected by Article 21 and any such limit cannot be justified constitutionally.

The bench, while citing the KS Puttaswamy case, said that as observed in the KS Puttaswamy case, the issue of obtaining sensitive personal details of a child would be likely to violate his right to privacy under Article 21 of the Constitution of India. .

What was the order of Delhi government?

The single bench of the court had stayed the implementation of the circulars of the Delhi government issued on 12 July 2022 and 02 February 2023. The Delhi government had said in its order that from the upcoming session of 2023-24, Aadhaar will be mandatory for the online admission process for EWS or DG in private unaided schools of Delhi.

In the subsequent notification, the state government had made Aadhaar of the child mandatory to avoid duplication of EWS/DG/CWSN applications. Challenging this circular, the father of a child had alleged that his five-year-old child was not able to participate in the online admission process at the entrance class level because he did not have an Aadhaar card.
