What does the rule say?

Just like if you are found drinking alcohol in your car or you are driving a car after consuming alcohol, then also your challan is issued. Similarly, if you are caught smoking while sitting in the car, then the traffic police can fine you.

First of all, know that drinking alcohol and smoking inside a car is a legal offense under section DMVR 86.1(5)/177 of the Motor Vehicle Act. You cannot smoke cigarettes in a public place or even in your car. If you are caught smoking in a car, you can be fined. So avoid doing this.

Penalty is imposed
If you are caught smoking in a car, a challan is issued in two ways. One, if you are caught smoking for the first time while sitting in a car or any public place, then a challan of Rs 100 is issued under section 86.1(5)/177 of the Motor Vehicle Act. Whereas, if you are caught doing this for the second time, then a challan of Rs 300 can be issued.

Here you also have to understand why such a rule has been made. Smoking while sitting in a car is prohibited so smoking in a public place can be stopped. Therefore, avoid smoking cigarettes, etc. while sitting in a car, so that your challan is not issued.
