What is surrogacy?
Surrogacy means giving birth to a child through a rented womb. Many celebrities including Shahrukh Khan and Gauri Khan's younger son Abram, Priyanka Chopra, and Nick Jonas' daughter Malti Jonas have adopted surrogacy.
What are the rules on maternity leave for surrogacy?
The central government has recently made changes in the Central Civil Services (Leave) Rules 1972. According to the new changes and rules, women who are becoming mothers through surrogacy (mothers who raise a child born through surrogacy) can take maternity leave to take care of their child.
Along with this, this rule is also applicable to fathers. Male employees who have become fathers through surrogacy can get 15 days of paternity leave within 6 months from the date of birth of the child. Such a rule can be a relief for single male government employees.
Rules for maternity leave
According to the revised rules issued by the Ministry of Personnel, the surrogate as well as the adoptive mother (mother who gives birth and raises the child) have the right to maternity leave. According to the rule, the female employee should have less than two living children. In case of being in government service, 180 days of maternity leave can be given. At the same time, according to the earlier rule, under child care leave, a maximum of 730 days of leave can be availed during the service period for child care such as education, illness, etc.
