Change of name is a common practice in India and after marriage, a girl is asked in many places to change her surname. However, let me tell you that legally in India, if a girl does not want to change her name even after marriage, then she has every right to do so. But if you want to get it changed then you have to do much legal work. For example, you will also have to change each of your documents.

So let us give you some information about how to legally change the name in India today.

Notarized affidavits and gazette publication are two ways to do this.

First Method Notarized Affidavit

  • In this, first of all, you have to give a joint affidavit which contains the declaration of marriage. It will contain the name, new name, husband's name and address etc. before marriage.
  • This affidavit will have to be made on a stamp paper of Rs 10 and will be signed by both husband and wife.
  • It will also carry a marriage certificate and passport size photograph.
  • Now you pay the fee of affidavit to the notary and after that give an advertisement in your name in the local newspaper and magazine etc.

Change your name in the document like this

Now you have to change your name in all the documents. This name should be the same as you have given in the affidavit-

PAN Card- To change the name on the PAN card, you will need a marriage certificate or gazette affidavit with this an application will have to be given to the Income Tax PAN Service Unit.

Passport- To get your new passport made, a marriage certificate, copy of your husband's passport and other details will have to be given to the passport office along with the old passport.

Bank- You have to get your name changed in the bank account along with the affidavit and marriage certificate.

Driving License- Marriage certificate and legal address proof along with your application will have to be submitted to the RTO office for further processing.

Second-way gazette affidavit

  • First of all, you have to submit a copy of your marriage certificate and address proof to the gazette department in which you will have to request for change of name.
  • You must have all the supporting documents ready or else your application will not be approved.
  • You can request the department to publish this in future also.
  • After this, the gazette notification will reach your address in the next 15 to 20 days.
  • After this, the advertisement of your name will have to be given in the local newspaper.
